Texas Still Has a Law Banning Homosexual Conduct on the Books. You’ll Never Believe Who’s Trying to Repeal It.
In 1998, four Harris County deputies arrested John Geddes Lawrence Jr. and Tyron Garner after a jealous acquaintance made a false report to police alleging that one of the men had been “going crazy with a gun.” When the deputies arrived at Lawrence’s apartment, they didn’t find a gun. Instead, they found the two men having sex, and they decided to arrest them anyway. Lawrence and Garner were charged with violating Section 21.06 of the Texas Penal Code, which since 1973 has banned “deviate sexual intercourse with an individual of the same sex.” If you’re familiar at all with the case, it’s probably because of the 2003 Supreme Court decision that resulted from the arrest, Lawrence v.
